This Policy applies to the processing of L&G Electric Customers' data, i.e. you, if you are a natural person, or employees or members of the bodies of a legal entity, or visitors to L&G Electric's Website, always to the extent of the personal data corresponding to your position in relation to L&G Electric ("you").

The purpose of this Policy is to comply with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), as consolidated by Act No. 110/2019 Coll, on the processing of personal data (hereinafter referred to as the "GDPR") to provide you with information on what personal data L&G Electric, as the data controller, processes about natural persons in the performance of its business activities, for what purposes and for how long it processes such personal data in accordance with applicable law, to whom and for what reason it is entitled to transfer them, as well as to inform you about what rights natural persons have in connection with the processing of their personal data and how they can exercise them and against whom.

3. Personal Data Categories

We process the following categories of personal data:

Personal data is any information relating to you that enables L&G Electric to identify you. The following categories of personal data may be processed in connection with the performance of L&G Electric's activities.

3.1. Basic personal identification data

Such data which is, or in certain cases may be, necessary to enter into a contract with you. This includes in particular the following personal data:

academic degree;
name and surname;
date of birth;
address of residence / registered office;
Your job title (if you are ordering our services/goods as a representative of the company);
Your position as a body in the company that is our Customer;
COMPANY ID NUMBER, VAT NUMBER.

bank account number;
data on payments made;
tax documents.

3.3. Record of e-mail communication and written communication

This includes in particular personal data contained in e-mail and written communications with you.

3.4. Cookies

These are cookies, which are pieces of information used to measure traffic to the Website and to generate various statistics related to the Website.

4. Purpose, Duration and Legal Basis for the Processing of Personal Data

4.1. Processing of Personal data in the Performance of a Contractual Obligation

In order for us to provide you with our services, they need to know your personal data, which they must then process. Your personal data is processed by L&G Electric mainly for the purpose of signing and fulfilling a contract for work (or a purchase contract) between you and L&G Electric, where the legal title of the processing is the performance of the contract. For these purposes, your personal data is processed within the scope of the Basic Personal Identification Data as set out above in Art.

4.2. of the Policy

These personal data are processed by L&G Electric only for the duration of the contractual relationship between you and L&G Electric and for a period of five years after the termination of the provision of performance under the contractual relationship, or for as long as required by law.

4.3. Processing of Personal Data in the Performance of a Legal Obligation

In providing the performance, L&G Electric is obliged to comply with the following legal obligations. These are Act No. 563/1991 Coll., on Accounting, as amended (hereinafter referred to as the "Act on Accounting"); Act No. 586/1992 Coll., on Income Taxes, as amended (hereinafter referred to as the "Act on Income Taxes") and Act No. 235/2004 Coll., on Value Added Tax, as amended (hereinafter referred to as the "VAT Act").

Some personal data may be included on accounting documents (invoices or other documents), and the above laws require L&G Electric to retain these documents for up to 10 years. If L&G Electric is legally obliged to archive these documents, your personal data on the relevant document will be stored with them.

4.4. PProcessing of Personal Data on the Basis of Legitimate Interest

If you are in default of payment of a monetary obligation, if you fail to meet another obligation, or if L&G Electric suffers other damage or harm due to your side, L&G Electric may process personal data on the basis of a legitimate interest to enforce the claims in question and to protect the rights of the company. L&G Electric may retain your personal data for this purpose for the limitation period pursuant to Act No. 89/2012 Coll., Civil Code, as amended.

4.5. Processing of Personal Data on the Basis of Your Consent

L&G Electric may process your personal data only where required by law, where the processing is necessary for the performance of a contract or where it is based on a legitimate interest of L&G Electric.

5. Third Parties to whom L&G Electric May Transfer your Personal Data

L&G Electric uses third parties to exercise its rights and perform its obligations under the contracts. Insofar as these suppliers process personal data transmitted by L&G Electric, they have the status of data processors and process personal data only within the framework of instructions from L&G Electric and may not use it otherwise.

These include in particular:

subcontractor in the performance of the signed contract;
providers of accounting and tax services;
providers of IT, computer network and hardware management services;
cookies that L&G Electric processes when you visit its website
L&G Electric transmits your personal data to the administrative authorities and authorities specified by the applicable legislation in order to fulfil its legal obligations.

6. Your rights

If you exercise any of the rights set out below or any of your rights under applicable law, L&G Electric will inform you of the action taken or the erasure of your personal data or the restriction of processing in accordance with your request and will inform each recipient to whom the data has been disclosed in accordance with Article 6 of the Policy, provided that such disclosure is possible and/or does not require unreasonable efforts.

6.1. Right of Access to Your Personal Data

In accordance with Article 15 of the GDPR, you have the right to access your personal data, which includes the right to obtain confirmation from L&G Electric as to whether it processes your personal data, as well as access to information about the purpose of the processing, the categories of personal data concerned, the recipients to whom the personal data have been or will be disclosed, the planned period of processing, the existence of the right to request from L&G Electric the rectification or erasure of personal data relating to your personal data or the restriction of their processing or to object to such processing, the right to lodge a complaint with a supervisory authority, any available information about the source of the personal data if not obtained from the data subject, the fact that automated decision-making, including profiling, is taking place, appropriate safeguards for transfers outside the EU and, if the rights and freedoms of others will not be adversely affected, a copy of the personal data.

In the event of a repeat request, L&G Electric shall be entitled to charge a reasonable fee for a copy of the personal data, which shall be equivalent to the administrative costs of making such copy.

6.2. Right to Rectification of Inaccurate Data

In accordance with Article 16 of the GDPR, you have the right to have inaccurate personal data processed about you by L&G Electric corrected. Taking into account the purposes of data processing, you have the right to have incomplete personal data completed, including by providing an additional declaration.

6.3. Right to Erasure of Personal Data

In accordance with Article 17 of the GDPR, you have the right to erasure of personal data concerning you unless L&G Electric demonstrates legitimate grounds for processing the personal data.

6.4. Right to Restriction of Processing

In accordance with Article 18 of the GDPR, you have the right to restrict the processing of personal data until the complaint is resolved if you contest the accuracy of the personal data, the grounds for processing or if you object to the processing.

6.5. Right to Portability of Personal Data

In accordance with Article 20 of the GDPR, you have the right to the portability of the data concerning you that has been provided to L&G Electric in a structured, commonly used and machine-readable format. You also have the right to ask L&G Electric to transfer this data to another controller in certain cases.

In the event that the exercise of this right could adversely affect the rights and freedoms of third parties, it will not be possible to comply with your request.

6.6. Right to Object to the Processing of Personal Data

In accordance with Article 21 of the GDPR, you have the right to object to the processing of your personal data by L&G Electric.
If L&G Electric does not demonstrate that there is a compelling legitimate reason for the processing that overrides the interests or rights and freedoms of yourself, L&G Electric will terminate the processing without undue delay upon objection.

6.7. Right to Withdraw Consent to the Processing of Personal Data

If you give L&G Electric your consent to the processing of your personal data, you may withdraw it at any time. The withdrawal must be made in an express, comprehensible and specific expression of will, either in writing to the address of L&G Electric's registered office or via email at info@heli-iq.com.

6.8. Right to Contact the Data Protection Authority

You have the right to file a complaint regarding the processing of your personal data by L&G Electric with the Office for Personal Data Protection (Úřad pro ochranu osobních údajů), having its registered office at Pplk. Sochora 27, 170 00 Prague 7.

7. Updates to the Privacy Policy

L&G Electric informs you that it may modify or update this Policy from time to time. Any changes to this Policy will become effective when posted on the www.heli-iq.com website.
